Letter to lawyer seeking help for civil rights abuses by the City of San Diego
I wrote this email to another lawyer that I heard is not afraid to go after corrupt citys and police.
He
asked me to write a letter describing the abuses over the past 8
months. It's been a while so I probably left something out...

Since
May 06 I became extremely active with the Minutemen movement. I was
the prime videographer in this area so I was at most events. We
(American citizens) were always treated poorly, but that is irrelevant
since I do not have any video of those occurrences. They used to tell
me to turn my camera off and I would listen. It wasn't until November
of 06 when I learned that I did not have to turn my camera off. That
is when everything went down hill.
In
November we became aware of the sex trafficking and hundreds to
thousands of illegal alien squatters living in Mc Gonigle Canyon
because of neighbors and an NBC news report. On November 13 we went
there to clean up the canyon as the migrants were finally evicted. We
were threatened with arrest by Claudia Smith for picking up trash that
day like beer bottles, broken bike parts, radios and even a turtle
shell we found on one of their Santeria Cult graves. I have pictures
of what we found in the canyon here…
The
Mayor and Captain Boyd Long are both on news reports confirming this.
I also have pictures of the signs that Cal-Trans, DR Horton and Pardee
Homes posted on their properties that were frequented by this traffic.
We
initially went there to clean up the tons of trash left behind until I
ran across a grave. There was a migrant living there who talked to me
and confirmed that the child prostitution was still going on in the
canyon every Wednesday and Saturday as the news reports had previously
showed us.

Ana Garcia Exposes McGonigle Canyon!
After
a little looking around, we found the area. We took pictures and video
of what we found and turned them in to the SDPD, northeastern
division. Julie Adams and Jeff Schwilk had a relationship with the
city since they were fighting against this in their neighborhood. They
were continually ignored until they gave them the evidence proving that
it was still going on in the canyon. Captain Boyd Long had assured us
that they would have undercover in the canyon on 12/2/06 to break up
any child prostitution that still might be going on. We went there
that day to hide up in the bushes thinking we were going to take
pictures of police jumping out of bushes to save the girls… After
several hours it became clear that the police were not there, so we
called them. They reluctantly showed up in a nearby neighborhood where
I met them to tell them exactly where the crimes were going on. To
make a long story short, instead of trying to save the girls, they were
threatening to arrest me for 'tresspassing.' We recovered what
evidence we could and brought it to the captain, the chief of police
and then finally the mayor in a meeting we had in January. They
refused to even take the evidence that day, then went on the news to
deny that any of this happened.
2 weeks later, (February 8th) my house was raided.

After
coming in and handcuffing me, they said it was because they say I was
in Rancho Penasquitos on 1/27/07 'vandalizing' trash in this illegal
encampment. It was pretty easy to figure out where I was that day by
reading the paper or looking at videos, not to mention I have dozens of
affidavits stating where I was that day.

They
have yet to return my childrens' computer. I have called repeatedly
and they have yet to return one call. I have written about it and
there is a copy of an email I sent to all the city officials and people
involved in this situation…
Setting the stage for this raid…
Claudia
Smith who represents CRLA and CRLAF who is under federal investigation
for misappropriation of funds…using tax dollars to support and recruit
illegal aliens and making numerous false charges against anyone who
opposes her and her agenda. Each and every time, ALL charges have been
dropped against American citizens she has attacked and lied about. For
some reason when she snaps her fingers, police and media appear within
seconds to harass us based on her lies even though the truth has always
been available on videotape. They will not watch any of them!
In
November, John Monti was attacked by 8 of her favorite illegal aliens.
Not only did he report it, there were also eye witnesses driving by who
had also placed calls to 911 to report the attack.
Shortly
after my house was raided, John filed a grand jury investigation
against the SDPD northeastern division for refusing to act to protect
the girls in December when we were there asking for them to act.

Immediately
after he filed that, he was all of a sudden charged with assault
against the people who attacked him, along with charges for civil
rights abuses against the illegal aliens and another for lying to a
police officer. J Okay…of course the 911 callers didn't get charged with lying…
Of
course it was the same illegal aliens, the same police and the same
Claudia Smith behind these false charges against John. I also have
video proving they are lying about that attack. Charges were dropped
on that last week.
Here

for the attackers that were standing right behind him, Claudia Smith
and the main accuser in this so called crime I committed, Roberto Pena
who also has an outstanding felony car theft warrant and looks exactly
like a suspected rapist in that area that has never been found…

In
a nutshell, we were denied the right to peaceful assembly in a public
street because SDPD was taking orders from Enrique Morones. Not only
were we denied access, 2 other men who were on their side and clearly
there to support the migrants were unable to walk on the same street
and attend the rally because of the color of their skin. The officers
could not come up with a law that we were violating by being there even
though they had threatened to arrest me multiple times. The captain,
Mc Elroy also represented himself as an agent of the federal government
while he was denying our access to the rally that I went to videotape
just like anyone else.
We
were thrown around by the police, threatened, they did not give us
their names, badge numbers, complaint forms or take a citizens arrest
report after I was thrown around by the same cop 4 times. I was on the
phone with someone from SDPD telling me how to make a citizens arrest
even though he was a cop which is also our legal right to do, whether
they agree with it or not. They are still supposed to take the
report. They also falsely arrested my Mexican friend, of course so
that they could say it's wasn't racial after she asked a question.
Apparently you're not allowed to ask questions without a camera. She
was charged with 'tresspassing' and 'resisting arrest'. Those charges
were also dropped after seeing my videos.
They also tried to say that there were no trespassing sings which in the video you will see that they were 'no parking' signs.

were constantly harassed, threatened and assaulted, even to the point
of Enrique Morones getting on the bull horn to incite his crowd to riot
us for being there. Once again, the police did not protect us (me and
1 other woman) and watched as we were assaulted and intimidated the
entire time.

April
7, 2007 there was another event in that park where a man came with me
hoping that he would prevent the same type of riot. We did not have
any luck trying to video tape that event again and were assaulted
numerous times, threatened, intimidated and IGNORED by the police once
again.

After
that event I met with Lieutennent Tenny who said she wanted to help. I
brought her a disk of everything that happened on those 2 days that she
said she would review to see if any of our rights were being violated.
Her final decision was that no one did anything wrong.
April 25, 2007 I attempted to attend another public rally in downtown
I
also thought that since I had already provided the department with the
civil and penal codes they continuously violated that it would be a
little more peaceful and fair.
Silly
me…not only was I treated the same, threatened, intimidated and
assaulted in front of police, they actually went out of their way to
try to arrest me! If that wasn't bad enough, you will also see them
conspire against me on video!

Most
of my property was returned at the end of April but they held on to my
childrens' computer. What was interesting about me receiving my
computer back was when I had checked it, for some reason EVERYTHING in
my computer that had to deal with 1/27 had been changed! I'm not
kidding! What's even more interesting than that is the dates were
changed to days that neither my computer nor camera even existed! I
have receipts to prove when my computer was built and when the parts
were bought. I called Defective Lenhart when I discovered that, the
investigator assigned to my case who was also ironically involved in
every other case trying to prosecute law abiding American citizens for
speaking out about the illegal alien issues in our community, and he
hung up on me.
I
have not heard from him since. In fact, I haven't heard from anyone
about any of this as they continue to ignore me and every request ever
made. The police have literally watched me get assaulted and REFUSE to
even take a report! Even when I was shot at, they told me I was lying,
even though there were witnesses there who were also shot at! They
never talked to them or even went to the location to look for shells!
Each and every time I try to deal with the city of
I
also received an anonymous call from someone claiming to be an ex
detective from that division that was warning me about their corruption
and told me that they would continue to harass me and set me up if I
don't shut my mouth about what they were doing to me an others.
It
is now 8 months later, and he has yet to return any of my calls and is
still holding on to my childrens' computer. I did receive a call from
another investigator in the department who is doing his best to help
even though this is not his case. He informed me that Lenhart was
keeping my computer to make sure that is was not 'stolen.' J
I
bought this computer 4 years ago from NMCI. They do all the computer
stuff for the Navy and Marines. My computer had a Navy sticker on it.
I have provided them with all the information they need to release my
computer, including the contact info for a supervisor there that can
type in the serial number and get a clearance in about 30 seconds.
They have yet to even respond to them…so what is the hold up?
Do they really need to hold on to my computer (that had NOTHING on the hard drive) for 8 months???
How
is it that these people can get a search warrant on me to take all my
videos and media because an illegal alien says I vandalized his trash
in an illegal encampment? Did they ever think to ask where I was that
day? It is very easily provable, even the news showed it!
I
am confident that I am being singled out here due to my activism. If
you really have the time to watch my videos you will see many
violations of my rights repeatedly while they actually sit back and
laugh about it!
I
have posted a bunch of civil and penal codes here that not only the
illegal alien supporters but the police violate every time I am in a
public place!

The
police use these exact same codes to try to go after law abiding
American citizens yet forget about them when it comes to me and my
rights. I thought the police were public servants that got paid to
protect our rights as citizens…? Why is it that I have to pull out my
pocket Constitution to remind them of the Oath they took to protect our
rights? Isn't that their job? Instead they are clearly violating my
rights while protecting the illegal aliens and supporters.
They
claim that we all have a right to free speech and peaceful assembly yet
it is obvious they are looking for violence and in fact provoking it
themselves. They are also clearly using selective enforcement by
punishing me, but ignoring it every time someone violates these codes
against me.
I'm sure I'm rambling so I will close this for now.
I'm
not a lawyer and don't really know anything about the legal system but
I do know the Constitution and what this City has done and continues to
do is in clear violation of the law.
I
don't know what else to do since I do not have a lawyer or know
anything about the court system. It's funny that when these things
happen to an illegal alien or someone with darker skin than myself it's
called discrimination…if it's me, I'm labeled a trouble maker….anyone
else it's called reverse discrimination. This does not make sense!
All laws should be enforced EQUALLY!!!
I
went to a meeting that Mayor Sanders held at Barrio Logan where he
admitted that they have ZERO money in their legal defense fund. That
was also the day that he admitted the secret deal he made behind closed
doors with La Raza (a brown supremacist group) that prevent our law
enforcement from reporting illegal aliens and their crimes.
That video and sound clips happened to make it over the airwaves which makes me an even bigger enemy to the state…

So
as you can imagine, I'm not getting any help from the City. I also
know that they have met with these Mexican government agents and have
so far raided the homes of 3 of the 4 people who met with him about the
canyon situation.
I
was also beat up on video another time and the police REFUSED to even
watch the video, of course no charges pressed for that assault again,
but they go after us if Claudia Smith and her illegal alien friends say
we did something wrong even though the videos show otherwise.

I
left another message on defective Lenharts phone again today. I have
called every week. The computer company has been waiting for his call
for 8 months.
I
am a law abiding citizen and only want to be treated equally. I do not
want to be afraid every time I go outside my door of what police
officer is going to harass me this time. I want to continue to go to
public events and get my job done, but as you have seen, I am unable to
do that without some kind of intervention.
There
are people in other states that have gone through the same types of
issues and have been able to get lawyers and file restraining orders
against the city to force them to do their job and leave us alone for
speaking our mind and showing up in places they are trying to protect
illegal activity.
What's
really ironic is that in all these rallies, they are speaking out
against the police, calling them racist and murderers, yet they
continue to protect them and treat me, the person who supports law as
if I'm a terrorist!
This is not the

rights are being stripped away daily and there doesn't seem to be
anyone around that will take them on and do something about this
mistreatment.
Please
let me know if I didn't explain myself clearly. I apologize, a lot has
been going on and with my lack of education in this field, I'm not even
sure of all the codes they are violating but I do know that every time
a police officer watches these videos they are outraged and say
something MUST BE DONE!

far as the Migrant March goes…the people on the other side are also
willing to testify about the discrimination they experienced and
another who will talk about what he heard the police tell him about how
they "always protect Enrique and do what he wants."
