7 months later...

It has been over 7 months since the SDPD stole my property under the color of the law.  On February 8, 2007 the SDPD Northeastern Division forcefully entered my house and handcuffed me, threatening me with arrest as they hauled off my computers, cameras and all digital media.  At the moment this was a surprise to me.  After about 30 minutes in my house, they released the handcuffs and told me why they were there.
They were searching my house because they say I was in McGonigle Canyon on January 27th, 2007 vandalizing trash in an illegal encampment that had been cleared out by Cal-Trans just 3 days prior.

That was the 2nd 'cleanup' by Cal-Trans that month.  I also have pictures of signs showing that they have had to go in their repeatedly to clean it out. 
According to the search warrant, there was a 6 foot blonde that entered the canyon that day around 1 PM to vandalize trash, cut up property, steal jewelry and electronics, all the while chasing the occupants with knives AND video-taping while screaming "f&$% Mexicans."  They assumed that 6 foot blond was me since they had all seen me before video taping.  Well, there are several problems with that story.  The first being, I did not have blonde hair that day.  The second and most important was that I could not have been there during those times.
I have at least 30 affidavits from people that I was with that day at least an hour and a half drive away.  Not only that, I am seen in their videos, pictures AND the front page of the Orange County Register.

After they informed me what it was they were looking for, I not only offered to cooperate, I offered to help them find what they were looking for.
Now, I'm not used to being a criminal, so I'm only familiar with what happens in movies.  I was expecting some kind of interrogation, lie detector test or at least the witnesses questioned.  Their star witness's are all illegal aliens, coached by Claudia Smith from CRLAF who is under investigation for misappropriation of funds...tax money they are alledgedly using for illegal aliens.

What's really interesting about their star witnesses is that on the day this happened, they told reporter Tania Luviano that they did not see who was responsible for the vandalism.

Roberto Pena is a suspected rapist with a car theft warrant out and the others have all given fake names and locations in our presense.  Claudia Smith is on video lying to the police numerous times about us in that very same area and always manages to get the police to do what she wants at the snap of her fingers...no questions asked.  Here is a video of her and her gang after one attempt to have us arrested...

They pretty much convicted me in the media and the public eye.  The leader of the group, or anyone else who was actually there all day, did not step up to say that they did not do it or that I was not there...He went to the police to make it look like I had done it and used that as the reason why 'he had to get rid of me'...my insubordinate, radical behavior.  Pretty timely for his slander campaign, being that he had just beat me up a few days after I refused to lie for him. 
What did he ask me to lie about???  On January 29th, I was on my way home from LAX when I was checking my messages for the day.  I received a panicked message from Jeff Schwilk who said I had to go to his house and watch the news report of what happened on the 27th.  I was in a hurry to get home, but I said I could stop by for a minute.  He played the report.  My jaw dropped.  At the end of the report it said something like, "if you know anyone who was in the canyon that day, please come forward and call crimestoppers."  So I asked what he was going to do.  He said, "What do you mean, we weren't there that day."  "Uh, yes you were," I replied.  Then he came back to let me know that I couldn't tell anyone they were there.  I asked why not if he didn't do that?  So the agreement was that I would not go out of my way to tell anyone they were there, since I really wasn't sure at the time how much of the report was true, BUT if someone asked me, of course I would tell the truth.  That was not good enough for him, but I will not lie to the police for ay reason...even though the police seem to like to lie.
Before I even got to the freeway, I received a 3rd party call from someone who was not there asking me, "What do you mean you're going to tell the truth?"  I asked, "What do you care, you weren't there?"
There was more to that conversation, but I'll save that for another time.  So how do I know who was there, you ask?  In Orange County at the day labor site protest I met a woman named Joyce Rogers.  She had asked me if she gave me a check, would I be able to get it to Jeff, the leader of the San Diego Minutemen.  Of course that was not going to be a problem since we saw each other at least 6 days a week. 
On my way home, I called him and a few others to see if they were still in the canyon because I wanted to go take pictures myself.  I was given instructions to take the 56 East and exit on Penasquitos Blvd.  I knew the area somewhat since we had protested at a day labor site across te street.  As I exited the freeway, their cars were right on the street and I parked behind them.  I walked out to the bike trail where one of the voluteers for that day, Daniel Duffield was waiting with a radio.  A couple minutes later, the group headed back up the hill to end their day.  I was told that they had been to 4 canyons that day everything was cleaned out.  I asked if they had checked on another area that we had recently discovered and they said they were too tired since they had been there all day already.  I was slightly disappointed for not being able to go down there and take pictures, but I was under the assumption that someone else did and I would see them.  I congratulated them on their work cleaning up the community then took off to get some coffee and gas.
I was there a total of about 10 mintues and my gas receipt said 4:05 or 4:10.  In the search warant, according to the star witness, the blond perpetrator of this crime (they only remembered they saw a week later), had left the canyon at 3:30.

So here we are 7 months later.  No one has been arrested, no one charged with anything, yet they still have my property.  I still have not been questioned, interrogated or given a lie detctor test like I had begged for.  I'm not a lawyer or anything, but if I'm not mistaken that seems to go against everything our country was founded on.  I thought that some of our inalienable rights were that no one can be deprived "Life, Liberty, or Property" without due process.  So unless Detective Lenhart is judge, jury and executioner, my rights have been alienated.  I also thought there was something in the 4th and 5th Ammendment that guarantees my privacy and protection from unlawful search and seizure...
Detective Lenhart has not returned one of my calls during this time.  The other people who actually were there in the canyon all day and had been known to do things like that in the past have all had their property returned, but me...?  Nope, I don't exist.  That's right, they have money and Minuteman attorneys...
What's even more unbearable, besides the fact that I lost my job due to this unlawful search and seizure, along with 7 months of slander thereafter, is that the police have treated me like I'm a terrorist or that I'm the enemy.  They have refused to protect my rights on many occasions such as my right to free speech and peaceful assembly.  They have even gone out of their way to arrest me for laws that do not exist and use force to threaten and intimidate me, while even conspiring against me on video!!!
It is a well known fact that this has hurt my life immensly and have been having trouble finding new employment.  It is also well known that I am very poor so I cannot afford to get a lawyer and do the things necessary with the city and others responsible for harming my life in this manner.

If you check out my youtube videos you will see how the SDPD treats me on a regular basis since this incident.  It is like I no longer exist or matter!

I have been the victim of numerous crimes since and not only will the police REFUSE to investigate or take a report, they basically accuse me of lying!  Well, video doesn't lie.  Why won't anyone watch them?  Why won't the police even take a report when I get assaulted in front of them?  Why do they think it's okay to push me around?

Guess what?  It's not okay!  They will have to answer to this behavior one of these days so they better hurry up and build their case against me and lock me up, or return my stuff with a public apology and reperations for the damage they have done to my life.

I also find it truly amazing that the people who were in the canyon that day never stepped forward to tell the truth or to at least confirm that I had nothing to do with whatever they did.  If it wasn't bad enough that they didn't stand up for the truth, they actually turned their backs on me and went out of their way to try to make me look guilty.  They have been attacking me from all angles, including calling my family, friends, church, neighbors and any other group they deem patriotic to slander me and 'warn' them about my 'delusional psychotic and dangerous' behavior.  They claim that I  will stop at nothing to "destroy the Minutemean movement."  If you don't believe me, go to sdminutemen.com and see for yourself.  They are more preoccupied with discrediting me with their lies to make sure that no one listens to what I have to say.
I'll use another blog to go in to how I feel about the Minutemen.  I'm going to close this for now and print it up and send it to all the city officials and chief of police. 
I am tired of being ignored!  I am tired of people attacking me and them treating me as if I don't matter!
I am tired of being treated like a second class citizen!
